What Are The Requirements For Cancellation Of Removal?

Cancellation of removal is available to permanent and non-permanent residents of the U.S. who meet certain requirements. A non-resident who has been living in the U.S. continuously for 10 years or more, has good moral character as demonstrated by the absence of a serious criminal record, and who can show that his or her removal would cause extreme and unusual hardship to an immediate family member who is a lawful permanent resident, may be eligible for cancellation of removal and a grant of permanent legal residence. Permanent residency status can be maintained as long as the relevant rules are respected.

A permanent resident who has been convicted of a crime resulting in removal proceedings may be eligible for cancellation of removal if he or she has been living in the U.S. for seven years or more and was not convicted of a crime within the first five years he or she lived in the U.S.
