Helping You Make Your American Dream Come True

How can I prove my relationship with my fiancé is real?

On Behalf of | Oct 11, 2024

When you apply for a K-1 fiancé visa, one of the most challenging aspects of your petition could be proving that you have a bona fide, or real, relationship. You must prove your relationship is real and not just a relationship on paper for immigration purposes.

There are several types of evidence you can use to prove your relationship is real.

Evidence of visiting each other

You and your fiancé have likely gone to visit each other over the course of your relationship. Provide documentation showing your travel arrangements. This can include airplane tickets, hotel receipts or any other receipts verifying your travel plans.

Obviously, the more documentation you can provide, the better. Evidence of several trips taken back and forth to visit one another is stronger than evidence of one trip.

Photographs

Photos of each other together show visual proof of your relationship. The photos should show you in various locations and at different times. There is no specific number of pictures that you should provide but at least five will help establish the authenticity of your relationship.

Provide specific information about each photo, such as the date it was taken, where it was taken and the names of everyone in the picture.

Communication logs

Frequent and continuing communication is essential in long-distance relationships. Today’s technology makes it easy to communicate with someone in another country and document that communication.

Communication logs are strong evidence that a relationship is genuine. Provide documentation of phone calls, video calls or messages from whatever messaging apps y9ou use.

Review your communication evidence before submission. Although you want to provide as much evidence as you can, make sure the content of the communications is appropriate and do not contain private or sensitive information.

Written statements

A written statement by you and your fiancé can strengthen your petition. The statement could describe how you met, how your relationship progressed, any major events or occasions and what your relationship means to you.

Family members or friends can also submit written declarations about their experiences with you as a couple and their own recollections of your relationship.

Requirements after approval

There are several other requirements that you must meet to obtain approval of a K-1 visa. Once these are met, your fiancé must come to the U.S. within 6 months and you must get married within 90 days. Your spouse may then apply for a spousal green card.

You may assume that proving your relationship is real will be easy, but your K-1 application will be intensely scrutinized by immigration authorities. Learning that your application is denied can be a crushing blow when you are waiting to be with the one you love.

Submitting additional evidence or documentation can result in an eventual approval, but it often means a more lengthy and costly process, depriving you of time you could be spending with your fiancé.

It is best to have someone familiar with the immigration process to guide you through any complications that may arise.
