USCIS may consider social media posts as evidence

If you are going through the immigration process, you may be dealing with USCIS. It is one of the government services that works to process your case, investigate your claim and make determinations about your status.

In the course of this investigation, one area that USCIS may look at is your social media profiles. They do typically claim that they are not proactively monitoring social media activity. However, when a person makes a specific request, such as requesting benefits, a visa or an adjustment of status, evidence from social media could be used to make the determination.

Green card marriage cases

This could be relevant to any type of immigration case. Someone may be seeking an employment visa, for example, or a student visa.

But one of the more common times social media may be considered is when someone is requesting a green card due to marriage to a U.S. citizen.

The government does issue green cards on the basis of marriage, but it is wary of green card marriage fraud. Social media posts may be used to determine the validity of the relationship. If a couple’s posts make it appear that they are not actually in an authentic relationship or that they have misrepresented the terms of that relationship, this can cause significant issues with their green card application.

Navigating a complicated case

Being careful about what you post on social media can help in any type of immigration case or adjustment of status. But even if you are careful with your posting, these cases can still be very complicated, which is when it is helpful to work with an experienced attorney.
